By creating a FloorPins account you agree to these Terms. If you are using FloorPins on behalf of an organisation, you represent that you have authority to bind that organisation.
FloorPins provides a web-based platform for field equipment surveys, floor-plan annotation, and data export. We may change or discontinue features with reasonable notice.
You retain all rights to the data, floor plans, and photos you upload. You grant FloorPins a limited licence to store and process that data solely to provide the service to you.
You must not use FloorPins to upload unlawful content, attempt to access other tenants' data, or interfere with the platform's operation.
FloorPins is not designed or authorised for the storage or processing of Protected Health Information (PHI) as defined under the U.S. Health Insurance Portability and Accountability Act (HIPAA) or comparable health data laws in other jurisdictions. We do not currently sign Business Associate Agreements (BAAs).
You agree NOT to upload, store, or otherwise transmit through the Service:
If your work involves healthcare facilities, you are solely responsible for ensuring that data uploaded to FloorPins is anonymised and contains no PHI. Violation of this clause may result in immediate account suspension and deletion of affected content.
If you require HIPAA-compliant operation, contact us before using the Service — we may be able to scope a separate engagement, but the standard Service is not HIPAA-covered.
You may delete your account at any time from your profile settings. We may suspend or terminate accounts that violate these Terms.
FloorPins is provided "as is". To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or your use of the service shall not exceed the greater of (a) the fees you paid to FloorPins in the twelve months preceding the claim, or (b) USD $100. We are not liable for indirect, incidental, special, or consequential damages of any kind, even if advised of the possibility of such damages.
You represent that you have all necessary rights to the content you upload (floor plans, photos, survey data). You agree to indemnify and hold FloorPins harmless from any third-party claims arising from content you submit that infringes any intellectual property right.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
We will notify registered users of material changes to these Terms by email or in-app notice at least 14 days before they take effect.
